The increase in the annual revenue ceiling begins in 2018

Companies with revenue of up to R$ 4.8 million next year will be able to qualify under the rules of the Simples. This year, the limit is up to R$ 3.6 million in revenue. This is one of the changes regulated by the government, published in the Official Gazette on the 28th.

According to the Management Committee of the Simples, the limits for the collection of ICMS and ISS in the form of the Simples Nacional (Brazil’s simplified tax regime) remained at R$ 3.6 million. Thus, a company with revenue between R$ 3.6 million and R$ 4.8 million, in 2018, may be an opter for the Simples Nacional and, at the same time, have to fulfill its obligations relating to ICMS and ISS in the respective state, Federal District, or municipality.

The revenue ceiling for micro-enterprises and for the individual micro-entrepreneur also rose. Currently, to be included in the program, a micro-enterprise must have annual revenue of up to R$ 360 thousand. In 2018, the limit for micro-enterprises will rise to R$ 900 thousand. In the case of the Individual Micro-Entrepreneur (MEI), the annual revenue ceiling will go from up to R$ 60 thousand this year to up to R$ 81 thousand from 2018 onward.

The change had been approved and sanctioned in 2016; see here. For more information, access the full text of CGSN Resolution No. 135/2017 here. The Lassori firm’s team is also available to assist.
