Real estate contract termination should only return to the agenda in August

The President of the Senate, Eunício Oliveira (MDB-CE), said on the 10th that he does not intend to schedule for a vote the proposal that establishes rules for withdrawing from the purchase of off-plan properties, the so-called real estate contract termination (distrato imobiliário). The measure was rejected last Tuesday in the Senate’s Economic Affairs Committee (CAE) of the Senate, but could still be assessed by the senators in the plenary of the House.

“I think an understanding must be sought. It is not possible to simply schedule the project that was defeated in the CAE due to a lack of understanding on the issue. So, we can reach the understanding and, at the beginning of August, vote on this matter,” argued the parliamentarian.

Currently, there is no law that regulates contract terminations and, often, the cases of withdrawal end up in court. Given the absence of regulation, people who do not have the financial means to go to court end up without receiving back the amounts that have already been paid. But, for the majority of the CAE senators, the project that was rejected today would not solve the problem of legal uncertainty and would harm borrowers.

The senator also said that he has been working with the President of the Chamber of Deputies, Rodrigo Maia (DEM-RJ), to define a voting agenda for the second half of this year, in view of the electoral calendar.

“We are also already drawing up a calendar for the month of August, so that we have, at least after the [party] conventions [which define the candidates for each elective office], two weeks of a work task force. In September, we are checking which weeks we will have in relation to the work. Congress will not stop,” stated Eunício.
