Inheritance is a topic that can give rise to many doubts and disputes, in addition to being a delicate moment marked by an emotional burden. For this reason, it is important to be informed and to plan so that the process is as smooth as possible. This care becomes even more necessary when the person has no children or spouse, which can make succession more complex.
In such cases, it is common to think that there will be no heirs. However, Brazilian legislation provides for a line of succession that includes ascendants, such as parents and grandparents, which makes it quite rare for someone to have no heir at all to receive the inheritance.
The importance of succession planning
In this context, succession planning becomes even more important. This procedure consists of organizing, during one’s lifetime, the transfer of assets to heirs or successors, with the aim of minimizing conflicts and ensuring transparency in the transmission of assets.
In the case of people without descendants, spouses, or ascendants, succession planning allows them to freely choose to whom they wish to leave their assets in the inheritance. “If the person is single and their parents have already passed away, it means they have no forced heirs and, therefore, may dispose of the entirety of their assets, allocating them to whomever they wish. Thus, to third parties, friends, philanthropic entities, religious entities, NGOs,” emphasizes Juliana Assolari, partner at Lassori Advogados.
