The rural producer, by not being a businessperson subject to registration, is in a regular situation, even when carrying out agricultural economic activity prior to his registration with a Commercial Registry, since such registration is optional.
Based on this understanding and on precedents of the Superior Court of Justice (STJ), Judge Ricardo Gagliardi, of the 1st Civil Clerkship of Miranorte, granted a request for judicial reorganization to a group of rural producers from Tocantins.
With the decision, the Rodovalho group — composed of four members of the same family — obtained the right to renegotiate a liability estimated at R$ 60 million without running the risk of losing part of its assets or having to halt its activities during the process of liquidating the debts.
