Judges and court staff who use a digital certificate can access the Bacenjud system without the need to enter a password and ‘username’ in order to send judicial orders to the financial system—according to a disclosure made in mid-February by the National Council of Justice (CNJ).
According to the Central Bank, 98.5% of the requests for the blocking of funds or for information made by the Brazilian Justice system are made through Bacenjud. Since May of last year, the system began to include not only the 170 banks affiliated with the National Financial System of Brazil (SFN), but also 1,200 Brazilian credit cooperatives.
Created in 2001, Bacenjud is a system that interconnects the Judiciary with the Central Bank and banking institutions. The system makes the processing of judicial orders directed at the SFN, such as the blocking of funds in bank accounts, easier, faster, and more efficient.
With Bacenjud, the request reaches the banks electronically and the blocking is carried out quickly. Before the system, the request was forwarded by official letter and the effecting of the blocking was time-consuming.
According to counselor Carlos Eduardo Dias, a representative of the CNJ, the use of digital certification had already been undergoing testing in some courts. “Since the tests were approved, it is already possible to extend this possibility to all users. As a result, any judge or court staff member will be able to access the system via digital certificate, which dispenses with the use of login and password,” says the counselor. The use of login and password, however, will not be eliminated.
With the use of the digital certificate, the user does not need to remember the login and password when accessing the system or to re-register the password, as the system requires. “This is a password that needs to be changed periodically, so this generates a great deal of work for the person responsible for assigning the passwords,” states the counselor.
