Municipal Law No. 17,914, published on March 8, 2023, among other provisions, changes the rules on the settlement (transaction) of tax and non-tax debts with the city of São Paulo.
The benefits offered in the settlement procedures stand out:
- Discount of fines and interest up to a limit of 95%.
- Installment payment over up to 120 months.
- Special deadlines and forms of payment, including deferral and moratorium.
- Offering, replacement or disposal of guarantees and constraints, with the acceptance of in rem or personal guarantees, guarantee insurance, fiduciary assignment of credit rights, fiduciary disposal of real estate, and the taxpayer’s credits against the municipality.
The determination of the discounts, deadlines and forms of payment, and the installment conditions will observe various criteria. Such as the degree of recoverability of the debts, the time span of the debts, the debtor’s ability to pay, and the probability of success in judicial proceedings.
As for the degree of recoverability of the debts, the methodology for classifying the debtor will be considered confidential, and may be disclosed exclusively to the debtor itself.
